Reasons Why the Supreme Court Justices Voted in Favor of Pres. Marcos Burial

The Supreme Court of the Republic of the Philippines revealed the reasons why they decided to vote 9-5 in favor of the burial of Pres. Ferdinand Marcos at the Libingan ng mga Bayani.

The High Court headed by Chief Justice Ma. Lourdes Sereno relesed the decision on Tuesday, November 8, 2016, clearing all legal obstacles to a Marcos burial. Pres. Rody Duterte stated that he will abide with the decision of the Supreme Court if they will allow the burial of the late President at the Libingan ng mga Bayani.

According to Supreme Court Spokesperson Theodore Te some of the reasons cited by the Justices for allowing the burial of Pres. Marcos are listed below:

In a press briefing, SC Spokesperson Theodore Te announced some of the reasons cited by the justices for allowing the burial of Marcos:

  1. There was no grave abuse of discretion on the part of President Duterte in ordering the burial of Marcos; there is no law that prohibits the burial of the former president Marcos. 
  2. The President has the power to decide on the use of land within the public domain; there is no law that excludes the Libingan ng mga Bayani. 
  3. Marcos was former commander-in-chief, former soldier and former secretary of national defense. 
  4. Some justices disagreed with the position articulated by others that the former president was dishonorably discharged; this applies only to the military. 
  5. On the issue of moral turpitude: Marcos has not been convicted by any final judgment and the cases cited were all civil in nature. 

Although the decision of the Supreme Court is to allow the Marcos burial, the SC decision and final opinions of the justices were not released yet as they are expected to submit these on Thursday, November 10.
